Agreement to Terms

By accessing and using Explera DMC's yacht charter services, you accept and agree to be bound by the terms and provision of this agreement. These terms apply to all visitors, users, and others who access or use our services.

Booking and Reservations

Booking Confirmation

All bookings are subject to availability and confirmation. A booking is confirmed only when we send you a written confirmation and receive the required deposit payment.

Payment Terms

• A deposit of 30-50% is required to secure your booking
• Full payment is due 7 days before the charter date
• Late payments may result in booking cancellation
• All prices are in Thai Baht unless otherwise specified

Cancellation Policy

• Cancellations 14+ days before departure: Full refund
• Cancellations 7-14 days before departure: 50% refund
• Cancellations within 7 days: No refund
• Weather-related cancellations: Full refund or rescheduling

Charter Conditions

Age Requirements

The charterer must be at least 21 years old. Minors must be accompanied by adults at all times. Special safety measures apply for children under 12.

Passenger Limits

Maximum passenger capacity varies by yacht and is strictly enforced for safety reasons. Exceeding passenger limits may result in charter termination without refund.

Prohibited Activities

• Illegal drug use or possession
• Excessive alcohol consumption that endangers safety
• Smoking in enclosed areas (designated smoking areas only)
• Bringing pets without prior approval
• Fishing with unauthorized equipment
• Swimming in prohibited areas

Safety and Liability

Safety Compliance

All passengers must comply with safety instructions from the captain and crew. Life jackets must be worn when required. The captain has absolute authority regarding safety decisions.

Limitation of Liability

Explera DMC's liability is limited to the charter fee paid. We are not liable for indirect, consequential, or punitive damages. Passengers participate at their own risk.

Insurance

All yachts carry comprehensive insurance. Passengers are strongly advised to obtain travel insurance covering medical expenses, trip cancellation, and personal belongings.

Weather and Force Majeure

Charter operations may be modified, postponed, or cancelled due to adverse weather conditions, natural disasters, government restrictions, or other circumstances beyond our control. In such cases, we will offer rescheduling or full refund.

Itinerary Changes

The captain reserves the right to modify itineraries for safety reasons. Alternative activities or destinations will be provided when possible.

Damage and Additional Charges

Security Deposit

A refundable security deposit may be required for certain charters. This covers potential damages to the yacht or equipment.

Additional Fees

• Fuel surcharges for extended itineraries
• Marina and port fees
• Overtime charges for extended charters
• Cleaning fees for excessive mess
• Equipment replacement costs

Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy. By using our services, you consent to such processing and warrant that all data provided is accurate.

Intellectual Property

All content on our website and marketing materials is protected by copyright and trademark laws. Unauthorized use, reproduction, or distribution is prohibited.

Dispute Resolution

Governing Law

These terms are governed by Thai law. Any disputes will be resolved in the courts of Phuket, Thailand.

Mediation

We encourage resolution of disputes through mediation before pursuing legal action. Our customer service team is available to address concerns promptly.

Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be posted on our website and take effect immediately. Continued use of our services constitutes acceptance of modified terms.
